Essential Pre-Operation Approvals Required for Industrial Plants In Gujarat

1. Registration of Factory License:
To ensure safe working conditions, the Gujarat government mandates the registration of all factories under the Factories Act, 1948. The application for registration should include detailed information about the factory, including its location, nature of operations, and employee strength. This license ensures that the factory adheres to safety and health standards.

2. Registration under “The Shops & Establishment Act”:
All establishments, including factories, must register under the Gujarat Shops and Establishments Act. 3. Registration of Boilers under “The Boiler Act”:

The registration process includes a thorough inspection by a Boiler Inspector, who certifies the boiler’s safety.

4. Registration of Principal Employer’s Establishment under the provision of The Contract Labour:
For industrial plants employing contract labor, registration under the Contract Labour (Regulation and Abolition) Act, 1970, is required. The principal employer must submit an application to the registering officer of the area, providing details of the establishment and the nature of work carried out.

5. License for Contractors under the provision of The Contract Labour:
Contractors employing contract labor in the industrial plant must obtain a license under the Contract Labour (Regulation and Abolition) Act, 1970. This ensures that the contractor adheres to the prescribed labor standards and provides necessary amenities to the contract workers.

6. Consent to Operate:
Before commencing operations, industrial plants must obtain the Consent to Operate from the Gujarat Pollution Control Board (GPCB). This consent ensures that the plant complies with environmental standards and follows pollution control measures. The application should include details of the pollution control measures implemented and the expected emissions and efluents.

7. Retail/Wholesale Drug Sale License:
If the industrial plant deals with the manufacturing or sale of pharmaceutical products, obtaining a Retail/Wholesale Drug Sale License is mandatory. This license, issued by the State Drugs Control Department, ensures that the business complies with the Drugs and Cosmetics Act, ensuring the safety and quality of the drugs sold.

8. Factory Plan Approval:
Before construction begins, the factory’s building plan must be submitted to the Directorate of Industrial Safety and Health for approval. This ensures that the factory’s design adheres to safety norms and provides adequate provisions for employee welfare.
